Xand 3D – Terms of Service

Welcome to Xand 3D. These Terms of Service ("Terms") govern your access to and use of all 3D printing services offered by Xand 3D (“we,” “our,” or “us”). By using our services, you (“Customer,” “Client,” or “User”) agree to be bound by these Terms, including our Privacy and Confidentiality Policy. Please read them carefully before submitting any order, files, or payments.

1. Agreement to Terms

By accessing our services, placing an order, submitting files, or otherwise using our services, you agree to be legally bound by:

  • These Terms of Service,

  • Our Privacy and Confidentiality Policy,

  • Any supplemental agreements provided during project intake or file submission.

If you do not accept these Terms in their entirety, you must not use our services.

2. Description of Services

Xand 3D offers custom 3D printing solutions, including but not limited to:

  • Additive manufacturing (FDM, SLA, and other printing methods),

  • Print-on-demand using user-supplied 3D model files (typically .STL or .OBJ),

  • File evaluation, repair, and consultation,

  • Custom material selection (PLA, PETG, ABS, Resin, etc.),

  • Small-batch and prototyping services,

  • Non-disclosure design development (by request).

Each project is quoted based on volume, complexity, print time, material type, and post-processing requirements.

3. Customer Responsibilities

As a client of Xand 3D, you agree to:

  • Provide complete, accurate, and final design files prior to print scheduling.

  • Specify project needs, including quantity, material type, color, infill percentage, and tolerance if applicable.

  • Ensure that all uploaded files are virus-free, legally owned, and production-ready.

  • Respond in a timely manner to requests for clarification or revision.

  • Review quotes, timelines, and output expectations prior to payment.

Any issues arising from incorrect or incomplete information will be the sole responsibility of the customer.

4. Intellectual Property & File Ownership

We respect your ownership rights. When you submit a file to us, you acknowledge and agree:

  • You retain all legal rights and ownership over the design.

  • You grant Xand 3D a limited license to use the file solely for the purpose of fulfilling your order.

  • You affirm that the design does not infringe upon any third-party intellectual property rights, patents, copyrights, or trademarks.

  • You are responsible for ensuring compliance with all applicable laws regarding the design, use, or sale of your model.

Xand 3D does not accept liability for infringement caused by user-submitted files. We reserve the right to refuse any order we believe to be unlawful or in violation of IP rights.

5. Confidentiality and Privacy Commitment

We understand the sensitivity of your designs and business information. Our Privacy and Confidentiality Promise includes:

  • All files, communications, and customer details are treated as strictly confidential.

  • We do not disclose, sell, or share any personal or business data unless explicitly required by law.

  • All data is stored securely and accessed only by authorized personnel.

  • Customers may request access, correction, or deletion of stored data at any time.

Your information remains confidential indefinitely, even after your project is completed.

6. Quoting and Payment Policy

6.1 Quote Process

Each order is quoted individually based on:

  • Model complexity and size,

  • Print time and post-processing,

  • Materials used and delivery requirements.

Quotes are valid for 14 days unless otherwise specified.

6.2 Payment Requirements

  • Full payment is required prior to print initiation.

  • Accepted payment methods include: [list methods: e.g., PayPal, credit card, bank transfer].

  • Orders are non-refundable once production begins unless a manufacturing defect is verified.

6.3 Chargebacks and Dispute Waiver

By paying for services at Xand 3D, you agree to waive your right to issue a chargeback or payment dispute unless fraud or unauthorized use of your financial instrument can be proven.

  • We maintain clear records of order confirmation, project files, and communication to resolve any disputes internally.

  • Unjustified chargebacks will result in permanent account suspension and legal recourse.

7. Order Changes and Cancellations

  • Pre-Production: Changes or cancellations are accepted if materials have not yet been committed and the print job has not begun.

  • Post-Production Start: No cancellations, refunds, or major modifications will be accepted once printing is underway.

  • Design Revisions: If a customer wishes to update a file mid-project, a new quote may be issued and reprint fees may apply.

8. Production, Delivery & Risk of Loss

8.1 Production Time

Standard turnaround is 2–10 business days depending on queue and complexity. Rush orders may be accepted with a surcharge.

8.2 Shipping & Delivery

We are not liable for delays caused by third-party carriers. Tracking numbers are provided upon shipment.

Risk of loss transfers to the customer once the package is handed to the courier.

9. Quality Assurance & Return Policy

9.1 Acceptable Quality

All parts are subject to normal tolerances of 3D printing processes. Minor surface imperfections, support marks, or visual inconsistencies are expected.

We do not guarantee cosmetic perfection unless explicitly part of the agreement.

9.2 Defects & Reprints

If an item is found to be defective due to material failure or internal print error:

  • You must notify us within 3 business days of delivery,

  • You must provide photographic or video proof,

  • We will offer either a free reprint or a partial/full refund at our discretion.

No returns or reprints will be granted based on:

  • Cosmetic expectations not discussed prior to production,

  • Errors in customer-supplied files,

  • Shipping damage caused by courier (insurance claims apply).

10. Limitation of Liability

To the maximum extent permitted by law, Xand 3D shall not be liable for:

  • Any indirect, special, incidental, or consequential damages,

  • Personal injury or property damage resulting from use or misuse of printed items,

  • Loss of data, revenue, profit, or business opportunity.

Total liability shall not exceed the price paid for the service or product that caused the claim.

11. Termination of Service

We reserve the right to:

  • Refuse service to anyone for any reason,

  • Cancel projects deemed illegal, unethical, or high risk,

  • Suspend or terminate accounts suspected of fraud or abuse.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of [Insert State, e.g., Michigan], without regard to conflict of law principles.

You agree that any disputes arising under these Terms or in connection with services provided shall be subject to the exclusive jurisdiction of the courts located in [Insert County and State].
